By accessing, registering, or using any services provided by Novella (including but not limited to the Stock Sight dashboard, Temporary Mailboxes, Bot Hosting, and API services), you explicitly agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must immediately cease usage of our services.

We reserve the right to modify, suspend, or terminate any service or account at our sole discretion, at any time, with or without notice, for any reason.

2. Absolute Limitation of Liability

UNDER NO CIRCUMSTANCES SHALL NOVELLA, ITS CREATORS, OWNERS, DEVELOPERS, ADMINISTRATORS, OR AFFILIATES BE HELD LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES WHATSOEVER.

This comprehensive waiver of liability applies to, but is not limited to:

  • Financial Loss: Any monetary losses, lost profits, or business interruptions arising from the use of our bots, trading tools, API integrations, or system downtime.
  • Data Loss: The deletion, corruption, or failure to store any data, including temporary emails, account credentials, configuration files, and bot data.
  • Third-Party Actions: Any actions taken by third-party platforms (e.g., Discord, Trading platforms) resulting in your account being banned, suspended, or penalized due to the use of our services.
  • Security Breaches: Any unauthorized access to your account or data.

By utilizing this platform, you expressly acknowledge and agree that your maximum remedy for any claim relating to the use of this service is to cease using the service.

3. "As Is" and "As Available" Disclaimer

All services, software, bots, APIs, and temporary mailboxes provided by Novella are provided strictly on an "AS IS" and "AS AVAILABLE" basis.

WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that:

  • The service will meet your specific requirements.
  • The service will be uninterrupted, timely, secure, or completely error-free.
  • The results that may be obtained from the use of the service will be accurate or reliable.
  • Temporary emails will successfully receive all incoming messages or avoid spam filters.

4. Acceptable Use Policy

You agree not to use our services (including but not limited to the Temporary Mailboxes and hosted Bots) for any illegal, malicious, or abusive activities. This includes, but is not limited to:

  • Conducting illegal activities, fraud, or phishing.
  • Distributing malware, viruses, or malicious code.
  • Bypassing rate limits, spamming, or executing Denial of Service (DoS) attacks against our infrastructure or third-party targets.
  • Violating the Terms of Service of third-party platforms (e.g., Discord, APIs) through our bot hosting.

We claim absolutely no responsibility or liability for how you choose to utilize the tools provided. However, we reserve the right to immediately terminate and delete any account found to be abusing the platform, without warning or refund.

5. Privacy Policy

Your privacy is important to us, but you must understand how data is handled on our platform:

  • Data Collection: We collect only the information absolutely necessary to provide the service (e.g., usernames, hashed passwords, basic configuration data).
  • Temporary Mail: Emails received via our temporary mailbox service are processed and displayed to the intended recipient. We make no guarantees regarding the absolute privacy or encryption of incoming unencrypted standard emails. Emails and accounts are routinely purged from our database.
  • No Sale of Data: We do not sell, rent, or lease your personal information to third parties.
  • Law Enforcement: We reserve the right to disclose any information necessary to satisfy any applicable law, regulation, legal process, or governmental request.
  • Cookies: We use strictly necessary cookies (such as session tokens) to keep you logged in. By using the site, you consent to the use of these essential cookies.

6. Strict Indemnification

You agree to fully indemnify, defend, and hold harmless Novella, its owners, developers, and affiliates from and against any and all claims, lawsuits, damages, liabilities, costs, and expenses (including legal fees) arising directly or indirectly out of:

  • Your use or misuse of the services.
  • Your violation of these Terms & Conditions.
  • Your violation of any third-party rights, including copyright, property, or privacy rights.
  • Any claim that your use of our bots or temporary emails caused damage to a third party.
YOU ASSUME TOTAL RESPONSIBILITY AND RISK FOR YOUR USE OF THE SERVICE AND THE INTERNET.

7. Governing Law & Jurisdiction

These terms shall be governed by and construed in accordance with universal internet standards and applicable digital laws, without giving effect to any principles of conflicts of law. By using this service, you agree to waive any right to participate in a class action lawsuit or class-wide arbitration.
